We spoke to the legal director of 11Onze, Arcadi Sala-Planell, who explains why it is so difficult to exercise this right in case of non-payment of the mortgage.<\/b><\/h3>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">\u201cVulture funds are very powerful international funds that buy up mortgages from financial institutions,\u201d Sala-Planell begins by explaining. In order to \u201cclean up or make up\u201d their accounts, he continues, the financial institutions \u201cassign\u201d \u2014 and he stresses the word well, because it is the key to justifying the legal obstacle, as we shall see \u2014 the mortgages of their clients in packages of thousands to the vulture funds, which are recorded as the holders. \u201c<\/span><b>They are acquiring these homes at a ridiculous price, as little as 10,000 euros each in some cases<\/b><span style=\"font-weight: 400;\">,\u201d 11Onze\u2019s legal chief warns.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">History repeats itself:<\/span><b> this procedure is too similar to the one used by real estate companies to \u2018assign\u2019 the so-called \u2018subprime\u2019 mortgages to investment funds<\/b><span style=\"font-weight: 400;\">, which in 2008 triggered an unprecedented global crisis. For this reason, experts warn of the risk of a new mortgage bubble bursting. \u201cThis has been going on for too many years&#8230; And the legal problem that consumers are facing is that you are still paying the mortgage at your financial institution, but it belongs to a vulture fund and the institution does not inform you\u2026,\u201d Sala-Planell warns. He believes that we should have the right to know.<\/span><\/p>\n\n      <\/div>\n    <\/div>\n  <\/div>\n<\/div>\n\n\n<div class=\"component gallery\">\n  <div class=\"container\">\n    <div class=\"row\">\n      <div class=\"col col-lg-10 offset-lg-1\">\n        <div id=\"slider\" class=\"carousel slide\">\n          <div class=\"carousel-inner\">\n            <div class=\"carousel-item active video-player inline-player\" data-video-id=\"6286565147001\">\n              <img decoding=\"async\" class=\"d-block w-100\" src=\"https:\/\/www.11onze.cat\/wp-content\/uploads\/2021\/12\/VISUALS_PODCAST_IMAGE_VIDEO_BLOCK_PSN_ARCADI.jpg\" alt=\"\">\n              <button type=\"button\" class=\"play\"><\/button>\n              <div class=\"carousel-caption\">\n                <p>Episode 7 | Bank abuse: Vulture funds<\/p>\n              <\/div>\n            <\/div>\n          <\/div>\n        <\/div>\n      <\/div>\n    <\/div>\n  <\/div>\n<\/div>\n\n<div class=\"component text\">\n  <div class=\"container\">\n\n\n    <div class=\"row\">\n      <div class=\"col  col-lg-8  offset-lg-2\">\n        <h3><b>What is the right of withdrawal?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Especially because, as he explains, when the user signs a mortgage contract with a financial institution, he has the right of withdrawal, i.e. <\/span><b>the right to acquire the property at the same price for which the vulture fund acquired it<\/b><span style=\"font-weight: 400;\">. \u201cIf you have a mortgage debt of 200,000 euros, for example, but the assignment of the mortgage by the financial institution to the vulture fund was only 10,000 euros, by paying 10,000 euros you should be able to keep the property and the rest of the debt is cancelled,\u201d the legal chief says.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Even so, in order to avoid mortgage arrears, not only is there a lot of misinformation on the subject, but <\/span><b>a series of legal tricks have been put in place to prevent people from exercising their right of withdrawal freely<\/b><span style=\"font-weight: 400;\">. This is where the word \u201cassignment\u201d serves its purpose. \u201cFinancial institutions and vulture funds do not use the word \u2018sale\u2019 in their contracts, but \u2018assignment of credit\u2019 and, for this reason, judges are rejecting the complaints on technical grounds and the withdrawal is not prospering,\u201d Sala-Planell denounces.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>Does a vulture fund facilitate or hinder an eviction?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">For the same reason, when a foreclosure occurs, i.e. when the person cannot pay the mortgage, even though it is the vulture fund that warns of non-payment, it is the financial institution that is in charge of carrying out the eviction on behalf of the vulture fund. \u201c<\/span><b>If the vulture fund were to do so, it would be demonstrating that it is the owner of a sale and purchase and, therefore, the user could claim his or her right of withdrawal<\/b><span style=\"font-weight: 400;\">,\u201d Sala-Planell argues.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Even so, the vulture funds are not only the ones that notify the owner of the non-payment of the mortgage, but also, when the user has to manage the debt or negotiate a mortgage reduction or a payment in lieu of payment, they have to do so with the vulture fund. <\/span><b>The management, at this point, becomes more complicated<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As many courts are not ruling in favour of clients, <\/span><b>one of the smartest strategies is to drag out the procedure<\/b><span style=\"font-weight: 400;\">. In this way, you gain room to negotiate, but also to find some abusive clause that can be used to declare the mortgage contract null and void and, therefore, also its sale to a vulture fund.
